The Buying Process

After finding your dream piece of real estate in Portugal, our team can help transfer the property into your name. Property transactions in Portugal are relatively straightforward and follow 3 easy steps: Reservation, Promissory, and Deeds.

Introducing Real Estate Portugal

Reservation

Once you are ready to make an offer on your dream property, your agent will negotiate with the seller. After a price has been agreed upon, you will enter into a Reservation Agreement and pay a reservation fee. This effectively takes the property off the market for a short reservation period of time, allowing your lawyer to conduct due diligence on the property to make sure everything is in order. It is important to note that nothing is set in stone at this stage. You have not entered into a contract to purchase, rather, you are merely reserving the property.

The reservation period and fee are negotiable. However, the usual reservation period is 15-30 days, with fees of €6,000 - €20,000 normally accepted.

Public Deed

Once you have finalized payment of the balance of the property and any additional taxes, you will receive a Public Deed your lawyer will use to then register the property in your name at the Land Registry. You will then be the owner of real estate in Portugal.

Promissory

After your lawyer has completed all the checks on the property documents, they will provide you with a report of their findings and advise you on the property.

Once you are satisfied with the property, you will enter into a promissory contract with the seller and pay a deposit. The promissory contract will detail the terms and conditions of the purchase. Deposits can vary but are normally in the range of 10-60% of the purchase price minus the reservation fee.

The contract is then legally registered. At this point, it is very difficult for you or the seller back out of the sale. In fact, Portugal has strict laws protecting the purchasers to a property transaction where the seller has to pay double the deposit amount already paid back to the purchaser if the seller pulls out of a promissory contract.
